论我国《消费者权益保护法》修改中的惩罚性赔偿制度的完善

摘要:
为降低消费者的维权成本和经营者的违法收益、提高消费者的维权收益和经营者的违法成本,本文主张进一步完善《消费者权益保护法》中的惩罚性赔偿制度,对所有惩罚性赔偿均采取"上不封顶、下要保底"的立法态度,大幅提升惩罚性赔偿的倍数,设置最低惩罚性倍数与最低赔偿额中择高赔偿的制度,对欺诈的认定不再苛求经营者的主观故意,也不再苛求消费者的缔约行为与经营者的欺诈行为之间有因果关系。
